Chancellor denies injunction in paper ballot case

Davidson County Chancellor Russell Perkins today denied an injunction to force Secretary of State Tre Hargett to comply with the Tennessee Voter Confidence Act.

After hearing from attorneys representing voter rights group Common Cause of Tennessee and attorney general lawyers defending the state officials accused of failing to act quickly on implementing paper ballots for the 2010 elections, Perkins said the plaintiffs did not make the case for extraordinary relief.

Sufficient evidence was not presented that voter’s right would be infringed upon or that action would be immediately necessary, he stated.

“It appears however that any risk of irreparable harm that exits is not sufficient for warranting a temporary injunction,” Perkins said.
