Environmental group, nonprofit sue PSC Metals over alleged Cumberland River pollution

The Tennessee Environmental Council and an East Nashville nonprofit organization have filed a citizen suit against PSC Metals for alleged environmental violations in the U.S. District Court for the Middle District of Tennessee.

PSC Metals operates a scrap metal recycling facility on the East bank of the Cumberland River. TEC and Rediscover East! claim that PSC Metals has been illegally dumping contaminated stormwater into the river to the detriment of local citizens.

The lawsuit references a 2011 Environmental Protection Agency report that slams PSC Metals for having a “consistent history of polluting the Cumberland River via illicit discharges of process water mixing with stormwater.”

The federal Clean Water Act allows citizens to file suit after giving a 60-day notice to the alleged offender, the EPA and the state. The plaintiffs filed that notice in January.

The notice claims that water samplings from a drain used by PSC had elevated levels of suspended solids, copper, lead, iron and zinc when tested in September 2010. Other samplings in 2011 and 2012 allegedly found industrial waste, oil and grease in the water.

The plaintiffs are asking the court to issue an injunction against PSC Metals to stop the alleged pollution. The suit also demands the maximum penalty under law — $37,500 per day everyday since Sept. 10, 2010.

PSC Metals general counsel at its corporate offices in Ohio couldn’t be reached for comment Thursday.

The PSC Metals scrap yard has long been seen as an eyesore in Nashville. The city has attempted to discuss relocating the metal processors off of their prime real estate in downtown Nashville.

A worthless piece of property only suitable for a scrap and junkyard has become ine of the best undeveloped properties in the city.

PCS Metals is not only polluting our city waters they are profiting from the copper theft that is costing Nashville property owners millions each year. PCS is noting but a bunch of crooks that buys stolen goods from thieves and turns around and sells it for a profit, all while polluting our waters. Throw these bums out of town.

As I recall, environmental engineers told me in the 90s that the soil there is so heavily contaminated with toxic metals....even the EPA toxic funds could not begin to cover the cost to successfully remove it all. It has seeped so far down below that it's nearly impossible to remove now. To attempt such a feat would only cause more pollution to our water source. Swear. One quote from them was, "It's a total disaster...so we just let it lie." I never dated that guy again. LOL

This property is a prime location for a development like Atlantic Station in Atlanta, which also was contaminated land. Build above it, with parking underneath. There, problem solved.

I also hate to inform you that I've been making over six figures since I was in my late twenties. NewYorker1 pretty much nailed it on the head. Drughead is wallowing in as much ignorant, bigoted, racist genetic drift as the Cumberland is in PSC toxic runoff. And by the way, the largest welfare recipients in TN are actually poor, rural, uneducated whites who vote along Tea Party lines, statistically speaking that is.

P.S. For the record, I'm a white, male Libertarian and take serious issue with the financial and health externalities associated with PSC that are being imposed on the public. Oh, and I also work 12-hour days, 6 days a week for a local research firm, have 15 years of higher education and make well into the 6-figures. I also own a land management company that does business in East.

This exchange more than adequately illustrates the dangers of the pollution discharged into Nashville's water.

Jughead is prosecution evidence exhibit number 1 to show the retardation caused by these toxic metals. Perhaps in keeping with his custom I should call him "Jugtard" so as not to tax an already limited mental capacity.
