Facing a vehicular homicide trial, Percy Thompson decided instead to plead guilty in the case involving the 2009 car wreck that killed 3-year-old Darius Buchanan.

Thompson was sentenced to 11 years in prison for the vehicular homicide by intoxication charge and another year for leaving the scene of an accident involving a death, according to the district attorney’s office. Thompson must serve the sentences consecutively.

Prior to the plea bargain, Thompson’s trial was set to begin Monday morning.

The accident happened around 1 p.m. on Oct. 31, 2009, after Thompson lost control of his car near Brick Church Pike and Ewing Drive. Witnesses later told police Thompson had been driving erratically at a high rate of speed just before it spun out and crashed into a vehicle in which Buchanan was a passenger.

Buchanan had been belted into child seat in the back seat but died from his injuries.

Thompson tried to run from the scene but police caught him shortly afterward. Investigators said Thompson’s blood alcohol content was nearly three times the legal limit.

Now if we can get all drunk drivers off the road, we'll all be safer. So sad that Darius had to die at such an early age. Sad for him and his parents.

Too many people, including our legal system (read that as attorneys and judges) fail to realize the lethality of driving under the influence of alcohol and other drugs. While incarceration won't bring back the victims nor will it ensure safety from other such drivers, it will surely keep all of us safer from those whose history includes multiple charges of DUI. I want to be safe and I want those about whom I care to be safe. That 2d or 3d DUI is reasonable cause for extended incarceration before the offender kills or maims. Show mercy to the victims but not the guilty.
