Mother claims son sexually assaulted at Nashville Shores

Tuesday, April 20, 2010 at 2:40am

A Maury County mother is suing Nashville Shores claiming two other boys sexually assaulted her 7-year-old son while attending a YMCA function at the water theme park.

The suit, which also names the Maury County YMCA and Lakeview Properties LLC as defendants, claims the organizations failed to provide adequate supervision and protect the child from harm or injury during a July 7 assault.

Claiming mental and emotional stress, the suit, filed in Davidson County Circuit Court on April 6, seeks a $500,000 judgment for “irreparable harm and damages.”

In response to a request for comment, YMCA of Middle Tennessee Director of Communications Jessica Fain offered the following statement.

“We are aware a suit has been filed, but unfortunately, I don't have any information, as we have not been served with the lawsuit as of yet, and are unaware of any of the allegations made in it."

Representatives from Nashville Shores did not immediately respond to requests for comment.

This is a huge industry. There are a lot of people out there that realize that the only way out of lower middle class is a major victory in court.

"$500k"? Kids 7, where was mommy dearest? The country should countersue for child abandonment.

Too easy to sue people these days. For sure this should be investigated, but every incident that happens in our lives has many facets. Lawsuits should be the last resort for solution. Too many attorneys...we need more mediators. It is almost a year since this incident - seems a bit 'fishy'.

No child should be abused anywhere, but knowing what the world is like today, and especially here in America, parents bear the ultimate responsibility for their children's welfare. Sometimes that means not leaving them in public places in the care of strangers.

gigibagoly, you need to slow down and use spell check, plus your sentence structure needs help.

Gay people are not necessarily child abusers. I agree the Y is not the place to have a meeting or a date with a lover, but you can't monitor everything.

Parents need to supervise their own kids in these group functions. It's that simple.

Wow, look at all the comments before the particulars of the case have even been made available. Slow down, people!

Wow its amazing what the world is coming to! If her son was sexually assaulted, why would you wait this long to do something about it. And another thing is why sue Nashville Shores. When the child was at the facility with the YMCA group. Makes no sense at all.

I used to work at Nashville Shores and it is not there responsibility to supervise the people there with the exception of the lifeguards and only then when they are in the water.
It falls on the YMCA staff to supervise the kids if the parents were not there.

Where did this "assault" happen as there are not a whole lot of secluded places at Nashville Shores with the exception of the bathroom and with as many people that visit there even the bathrooms are not that empty. The only other place would be the swimming area in the lake and the kid could have called out for help. If it was not in either of those places then it was out in the open so why did no one else see it happen?

Ultimatepa: Sidneyames - I don't think that this is an English class. Personally I was very poor in English (barely passed) but I was able to understand what gigigagoly was saying.

"gigibagoly, you need to slow down and use spell check, plus your sentence structure needs help."

This was an uncalled for criticism of someone who was doing their best to pass on info.

Ultimatepa: Richgoose - Intelligence and literacy - You CAN have one without the other. I know some very intelligent people who can barely read or write.
