Up for Debate: 'Copyright trolls' vs. piracy

Thursday, January 31, 2013 at 1:20am

Do you feel any sympathy for defendants who claim movie producers (particularly those in porn) are trolling them as copyright infringers for easy settlements? Is a wave of lawsuits seeking information matching up with owners of IP addresses simply cracking down on cases of "If you don't want to get caught don't do it"? Or a little bit of both?

It appears to me that the proliferation of lawyers in this country makes frivilous lawsuits a booming industry in itself. I don't expect this trend to subside in my lifetime.

In the words of Brannon Bishop, "You ain't seen nothing yet."

By: Rasputin72 on 1/31/13 at 1:24

frivolous

By: Ask01 on 1/31/13 at 5:48

I have far too much self respect, too many ethics, and a solid sense of right and wrong to be a lawyer, however, it seems the primary target should be the individual who uploaded the copyrighted materials in the first place.

Whoever downloaded these materials later could always argue they didn't know the copyrights were involved.

I view the entire situation as a scheme cooked up by lawyers to get rich.

By: Loner on 1/31/13 at 5:55

Good morning, Nashville.

Stealing is stealing...if you can't do the time, don't do the crime. I don't see how or why there should be an exception to the law in the case of stealing copyrighted pornographic material, as opposed to stealing non-pornographic copyrighted material.

I'm not an attorney, but it seems to me that, just because there may be a certain prurient interest here, that does not mean that copyright laws are not applicable. The law is the law, even if the protected material is of an adult nature.

I agree with the Rasp, a glut of lawyers means a glut of lawsuits....it's only natural....same goes for guns, a glut of guns means a glut of gun-related deaths....it's only natural.

By: Loner on 1/31/13 at 6:36

Off topic: That NRA dude in Alabama (a Nut, Redneck & A-hole), the guy who murdered a school bus driver with a handgun, is still holding a 6-year-old boy hostage in his underground bunker. It's international news.

Read this article and tell me how this obviously deranged man was able to own firearms....the gunner, Jimmy Lee Dykes, is the poster boy for the NRA....this shit has to cease.

With every law written it goes through a slew of lawyers before becoming that law.
99% are written in a very complicated and lengthy manner to encourage or protect
a few against the many. While admitting little interest in these particular cases, the
over all agenda of the "Protect and encourage" money grabbing schemes cooked
up by the legal system for more employment income has and is very disgusting
and extremely expensive for this nation. A simple real estate deal will require you
to sign 100 pages with all protecting only 1 party but none to the signer.

By: gdiafante on 1/31/13 at 6:40

Whoever downloaded these materials later could always argue they didn't know the copyrights were involved.

Ignorance of the law is not a defense. Usually, things created and put to a medium (especially A/V) likely has copyright issues, should be a no-brainer. It's more likely that the attitude was like that during Napster...I want it for free, what are you going to do, hunt me down?

With this lawsuit, the answer is...why yes, yes we will.

Frivilous? Perhaps. But online piracy/copyright infringement is legitimate.

By: gdiafante on 1/31/13 at 6:41

s/hb "frivilous"...in quotation marks to poke a little fun at Raspy...lol

By: Loner on 1/31/13 at 6:42

We got an Obama-hating gun nut right here, a regular NCP poster....but, like the nut in Alabama, we'll have to wait until after he snaps to disarm him....we must do something about the ease of which these obvious nut-jobs can acquire lethal firearms....locking the barn after the horse is stolen is not working out very well.

The feds should order LaPierre to go to Alabama and try to negotiate the gunner's surrender....that would be priceless footage.

By: yogiman on 1/31/13 at 7:00

Loner,

Being such a anti-gunner makes me wonder: What was you trained to defend yourself with in the Army, a pocket knife or an ice pick?

Fists are good but they don't work too well when your enemy is 4 feet away from you.

By: Loner on 1/31/13 at 7:06

Dammit...speaking of the devil.....AAARRRGGHHH.

By: yogiman on 1/31/13 at 7:38

Loner,

I know it doesn't mean anything to you, but I do not hate Barack Obama as a man. I do hate him for usurping that office, though. I, moreover, hate congress for allowing it to happen. That makes me wonder if they aren't in the takeover of our nation.

It made me ask Lamar Alexander and Bob Corker why the Senate questioned John McCain on his natural born status but didn't question Barack Obama.

I never got an answer from Corker. Alexander said the "checked him out" and he was eligible. But he couldn't tell me what data they used to determine him constitutionally eligible.

Now you tell me, if he was a natural born citizen, why did he advertise he was born in Kenya for 16 years? And when he lost his US citizenship, how could he get his natural born status back? That is, of course, if he was born in Kenya, how did he ever become an American citizen?

I'm still looking for an answer. Do you have one?

By: Loner on 1/31/13 at 7:42

Troll Droppings Avoidance Mode now operational......(click).

By: gdiafante on 1/31/13 at 7:49

Alexander was being polite, trying not to incite a nutjub, yogi. Yes, that's you.

I've already debunked every point you post (and repost...and repost...). You'll be looking for an answer up to the moment you die, because you'll never find what you want to hear in the truth.

That's your problem.

By: yogiman on 1/31/13 at 7:52

Interesting; I see where they are going to tear down Ronald Reagan's childhood home in Chicago and make it into a parking lot for Barry's presidential library.

By: gdiafante on 1/31/13 at 7:55

If we're lucky, yogi. If we're lucky.

By: yogiman on 1/31/13 at 7:58

Hang in there, gdiafante. I imagine you're young enough that someday you'll learn the facts.

And yes, the truth is what I want to hear. Do you know the truth? If so, give it to me with the facts proving you're right. You apparently like the lies better.

By: gdiafante on 1/31/13 at 8:04

I've given the truth to you many times yogi. Here's some more truth for you...you are in such complete denial that it prevents you from comprehending anything in conflict to your pre-conceived, ill-advised, beliefs.

In other words, you have mental issues. They have meds that can help.

By: bfra on 1/31/13 at 8:10

gdiafante - Judging by the garbage yogi puts on this board, meds can't help.

As you have posted "in detail", answers to all his garbage about Obama & he still continues to spew lies for over 4 years, he should be committed to a mental facility somewhere.

By: Kosh III on 1/31/13 at 8:13

"Ignorance of the law is not a defense."

Unless you are hiring illegal aliens, then it's fine to not know the person's status and break the law.

By: Kosh III on 1/31/13 at 8:14

"Interesting; I see where they are going to tear down Ronald Reagan's childhood home in Chicago"

Then I am sure all the righties will demand that this shrine be left untouched; no lese majeste for the right-wing deity.

By: gdiafante on 1/31/13 at 8:21

touche, Kosh...lol

By: Blanketnazi2 on 1/31/13 at 8:22

If it were so sacred why did the righties allow it to be locked up and abandoned for years? Bunch of whiners.

By: Loner on 1/31/13 at 8:24

The idea of "trolling for internet pirates" is quite fascinating.

I graduated from HS in 1965; the phrase, "trolling for internet pirates" would make no sense at the time. If some sage, back then, had predicted that "trolling for internet pirates" would be a legal issue in 2013, he probably would have been institutionalized.

The internet has rapidly altered the English language....and this alteration process is picking up speed....to me, it's quite amazing.

By: Loner on 1/31/13 at 8:28

They should douse the place with kerosene and let Gorbachev throw a lit torch onto the structure...."Mr. Gorbachev, burn down this house!"....poetic closure.

By: Loner on 1/31/13 at 8:30

Maybe, we let Jimmy Carter throw the torch? He could build a Habitat for Humanity house on the site...again, poetic closure.

By: gdiafante on 1/31/13 at 8:35

We should sell it to Iran for hostages.

By: yogiman on 1/31/13 at 8:38

I'm amazed, folks. How can you all "give me the facts" when Obama refuses to give them to you? You've give me the facts? I don't remember any facts you've given me, just what you think for yourselves.

For one thing, none of you have explained how he got his natural born status back after he became an Indonesian citizen.

And none of you have explained why he advertised he was born in Kenya and raised in Indonesia and Hawaii for 16 years.

And haven't any of you wondered why he put all of his papers under lock and key?

And I'm still wondering how he made it to the White House in 6 years after he became a Illinois State Senator when the general population had never heard of him. But I'm sure you all have the answers.

By: bfra on 1/31/13 at 8:41

Loner - Even a "click" doesn't get rid of the stench those troll droppings leave on the board.

By: gdiafante on 1/31/13 at 8:46

Here's the process, yogi...he ran for the Democratic nominee and beat Hillary Clinton in a two year process. Then he beat McCain in the general election. THAT'S how he made it to the White House.

He provided the required evidence under current law that met the qualifications to run. He won the election. His election was confirmed by Congress. The USSC has, by omission, concurred.

Nothing to see here folks...except a senile old man.

My other BINGO card this morning:

http://www.washingtonpost.com/world/middle_east/israel-boycotts-its-un-human-rights-review/2013/01/29/29d18336-6a43-11e2-af53-7b2b2a7510a8_allComments.html?ctab=all_&

We are talking world class chutzpah here.

By: Loner on 1/31/13 at 8:53

Light a stick of Nag Champa incense, Bfra....it helps....that and a good doob.

By: slacker on 1/31/13 at 8:55

Breaking news!!! Pundits are predicting that John Kerry's senate farewell address, will end sometime this afternoon.... developing

By: Loner on 1/31/13 at 8:58

I like the idea of selling Reagan's childhood home to the Iranians, Gd...they might agree to inspections of their nuclear facilities, in exchange for the house....their engineers would disassemble the house and ship it, piece by piece, to the Islamic Republic...it would be reassembled there and used for annual anti-American rallies etc. Sounds like a fair deal to me....the Israelis might even back the scheme.....such a deal!

By: Loner on 1/31/13 at 8:59

Thanks for the update, Slack....have you heard, barney Frank wants to fill Kerry's seat...no lie....gotta be the hair-spray.

By: Loner on 1/31/13 at 9:07

Barney claims he would just keep the seat warm...caretaker style...not go for the seat in his own right in the upcoming election....Barney says, "Erection? Yes. Election? No."

Barney already has a golden pension deal as a retired US Rep...he would be double-dipping... collecting a Senator's pension & bennies too....just for filling a seat. Frankly speaking, Frank is a parasite on the US Treasury....and he wants to suck more juice out of the body politic....like a huge flea on a sick dog.

By: slacker on 1/31/13 at 9:09

Loner, poor Barney was passed over, will not be permitted to fill the seat.
Barney is pissed.. he gonna bitch slap somebody..

By: Loner on 1/31/13 at 9:20

Israeli jets strike targets in Syria...here's the BINGO card:

http://www.washingtonpost.com/world/middle_east/reports-israeli-aircraft-fired-missile-along-lebanon-syria-border/2013/01/30/60fab2be-6adf-11e2-ada3-d86a4806d5ee_allComments.html?ctab=all_&

It's a fast-moving board.

By: yogiman on 1/31/13 at 9:23

gdiafante,

I'm afraid there's too much out there you don't know. But again, even though the "beat" everyone he run against, what law made him eligible to run if he wasn't a natural born citizen. And presuming he was a natural born citizen even though he advertised he was born in Kenya for 16 years, what law gave him his American citizenship back after he became an Indonesian citizen?

And really, gdiafante, has he returned to his American citizenship (if he ever had it)? When? And I'll still repeat: When did he change his name from Barry Soetoro back to Barack Obama?

I'm sorry, but you haven't looked into the matter past the 'opening page'.

It's regardless of who he beat, you cannot run for an office if you aren't legally eligible for that office.

As I've posted before, you had better worry more about congress than Barry.

By: Blanketnazi2 on 1/31/13 at 9:35

Obama was vetted when he ran for the Senate. I have a feeling those who vetted him have access to more information than you do, yogi. You can't even do a simple damn google search and you believe every damn conspiracy email out there.

By: BenDover on 1/31/13 at 9:37

Kerry's seat will go to Scott Brown... it'll give a little balance against Fauxcahontas. A little Massachusetts political osmosis, or something like that.

By: Loner on 1/31/13 at 9:40

Ben: If it's Brown, Barney may go down...down the road to erection, er, I mean election to the coveted seat....out of a sense of duty, of course.

By: Loner on 1/31/13 at 9:42

Izzat right, Slack? Thanks for the update....who did the MA Gov appoint, to fill Kerry's seat? (I'm too lazy to Google it...)

By: slacker on 1/31/13 at 9:46

Loner, I'm thinking Jim Nabors could fill the seat.
The gov. appointed somebody.. but like you.. I'm to lazy to google it.

By: Loner on 1/31/13 at 9:49

The Clintons, Donald Trump, Rupert Murdoch (FOX), and the entire Grand Old Party pumped millions into trying to prove that BHO was not eligible to run for POTUS...they all failed...but that has not had any effect on the die-hard Birthers....they cling to their ignorance bigotry, as if it were gold bullion.

The Republican Party needs to publicly denounce the Birthers...otherwise, the entire party suffers a diminution in its brand's quality and appeal. Silence on the issue is acquiescence.

By: BenDover on 1/31/13 at 9:52

The reason Barney's out is they snapped the lines taught on his ridiculously gerrymandered House district Loner. No way he'd win an at-large vote in the state.

By: Loner on 1/31/13 at 9:53

The Kerry seat will have to be steam cleaned...all that hair-spray residue over all those years...it's a toxic waste site now....the janitors claim that it glows in the dark.

By: gdiafante on 1/31/13 at 9:54

The Indonesian angle has been debunked too, yogi...yawn.

By: Loner on 1/31/13 at 9:55

Apparently, if one lives by the gerrymander, one dies by the gerrymander...can't the Fish & Wildlife Service do something about these territorial and predatory gerrymanders?

By: yogiman on 1/31/13 at 9:56

You're right, B2. I'll admit I'm pretty damn ignorant when it comes to using this computer. I'll confess I've learned some from you kids since I came on this site. Still more to go, though.

But I don't believe I'm as ignorant as you when it come to the Obama matter. First, he didn't need to be a natural born citizen to win the State Senate seat nor the National Senate seat. The only seats that must be occupied by a natural born citizen is the President's and Vice-President's of this nation.

I imagine I've got more information on this guy than all of you combined. Let's say it's equal to him getting us deeper into debt than all president before him combined.

How to get it out to you? I don't know... yet. Would you believe it even knowing it to be a fact? I doubt it based on your apparent admiration of him.
