Why .05 when they can't catch half the .08's now.? A large number of those
presently arrested have to wait months for a trial and about as long to put
in their 48 hours+ as jail time. " Doesn't sound prudent" as Mr.Carvey would
say, in spite of another Government Agency recommendation.

Should the legal blood alcohol content threshold be lowered from .08 to .05 as has been suggested by the NTSB has recommended?

Ridiculous.

0.05 is so low as to be within the margin of error for many, if not most breathalyzers....but for these professional zealots, logic and science are irrelevant...it's a modern day witch-hunt....and of course, it's all "FOR THE CHILDREN.

Who would dare to oppose such a highly moral and dedicated group of high-minded experts? Nobody.....ergo, this ridiculous idea will probably become law.

By: Loner on 5/15/13 at 5:54

Somebody's brother-in-law over at the NTSB must have cornered the market on a new generation of super-sensitive portable breathalyzer ?

We know that special interests call all the shots in Washington, DC....some special interest is lobbying for this change and the motivation is not very lofty....follow the money.....smells like another sweetheart contract deal.

By: Loner on 5/15/13 at 5:58

Certainly, the legal profession would lobby for this lowering of the standards for a DUI charge....ever since the divorce business went to hell, the legal eagles have had to resort to ambulance chasing, acting as soldiers in the Drug War and working the DUI-DWI motherlode.....again, follow the money.

By: BenDover on 5/15/13 at 6:17

You can pretty much anticipated the recommendation of every one of these boards and panels anymore. "Does it expand the bureaucracy and scope of government authority?"... "Do it".

By: BenDover on 5/15/13 at 6:19

Name that prophet... no lifelines.

"Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive. It may be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end, for they do so with the approval of their own conscience."

By: Rasputin72 on 5/15/13 at 6:22

Absolutely not! The DUI business is already one of the sleaziest laws on the books.

The DUI laws are already a contemporary version of the Prohibition era.

P.S. I am an observer of this law only. I am speaking with any personal experience with the law itself. The very thought of being subjected to a 49,000 dollar a year cop is enough in itself to keep me away from the wheel.

By: Loner on 5/15/13 at 6:23

It was only a few years ago, when the idea of forcing Americans to give self-incriminating evidence was generally considered to be unconstitutional, as it violated both the 5th and the 4th amendments....but, because there was a perceived greater good, an over-arching imperative, to protect the general population from drunken drivers, as opposed to preserving constitutional freedoms, DUI-DWI laws began to flourish in number and severity.

Same thing for “controlled substances”, such as Cannabis.

But when it comes to gun ownership and use, government has shied away from using this "greater good" concept, to control the gun-related carnage.

It's all about the special interests...there is no powerful lobby of freedom-loving drivers...there is no powerful pro-Cannabis lobby….but, there are several extremely powerful guns & ammo lobbies….we have the best government and criminal justice system that money can buy.

By: Rasputin72 on 5/15/13 at 6:25

Ben Dover..........Your 7:19 will not see a more and profound post if the entire county posts on this forum today.

By: Loner on 5/15/13 at 6:26

No lifelines, eh? Sounds like Jefferson or Franklin to me, Ben. It's certainly true.

By: Rasputin72 on 5/15/13 at 6:28

LONER....... Your 7:23 came very close.

By: Captain Nemo on 5/15/13 at 6:36

I had to use a life line Ben, but I want tell who.

With it B.A.C. being this low, I wonder if you could not be arrested for taking cough medicine.

Rasp wrote: "The very thought of being subjected to a 49,000 dollar a year cop is enough in itself to keep me away from the wheel."

Thurston Howell III used that same line in an episode of Gillgan's Island....I think that the same line appeared in a Grey Poupon ad in the early 80's.

Rasp, you need new material....schtick has a sell-by date.

By: Loner on 5/15/13 at 6:44

I can hear it now...."On the way to the dentist....gargling some Listerine on the way....swishin' & spitiin'...when all of a sudden a black & white cruiser pulls me over....I tell you, I'm innocent, your honor."

By: Loner on 5/15/13 at 6:46

Or this...."I just had three slices of Grandma's rum cake, your honor...it was her 100th birthday, she insisted."

By: Loner on 5/15/13 at 6:48

Maybe this...."Offficer, I thought that my orange juice tasted a little funny this morning, should have checked the sell-by date...must have fermented in my fridge."

By: Captain Nemo on 5/15/13 at 6:53

Loner-

If every in trouble Raspy old boy would kiss the ass of a $49,000 a year cop. Hell that fat ass would kiss the ass of a rent-a-cop.

By: Loner on 5/15/13 at 6:58

Since the air in a closed vehicle is rebreathed by all aboard, could the very presence of a thoroughly drunk person or two in the same car, along with a non-drinking driver, be enough to cause the non-drinking driver of that car to blow a 0.05 BAC?

With such a trace BAC level being sufficient for arrest & conviction, could designated drivers now be at risk?

By: Blanketnazi2 on 5/15/13 at 6:58

I agree with the rest of you. This doesn't prevent people from drinking and driving. If they truly cared about public safety they would take measures against the people who have multiple DUI's and are still driving and killing/hurting others and damaging property for which they will not pay to repair.

By: Loner on 5/15/13 at 6:59

Lightning storm closing in...gotta shut her down, kids....later.

By: Rasputin72 on 5/15/13 at 7:08

Nemo........For the record 6'0 and 177 lbs.

LONER.......I have no idea who Thurston Howell is but if "earned" arrogance was his gig he must have been an interesting man.

I doubt that he would have believed "Men are created equal"

He probably thought that All men should have equal opportunity.

Then again, I have no idea what he thought. I would bet that he was not a $49.000 dollar year cop with the ambition to billy club a backtalking wife of some multi millionaire.

Here you go Raspy old boy. You love to criticize the 47%, so here is the break down.

Good morning Blanket, I hope you don't mine my using the GOP story. After all it was you that alerted me to it.

Later Loner, I hope nothing shocking happen. ;-)

By: Blanketnazi2 on 5/15/13 at 7:40

Works for me, Nemo!

By: Captain Nemo on 5/15/13 at 7:49

I don’t care what size you think you are Raspy old boy you would kiss butt of any cop to save your asinine butt.

By: Loner on 5/15/13 at 7:51

Storm passed...it's like a painting outside right now..ominous looking sky behind a sunlit foreground...here's some Detlefesn art:

https://www.google.com/search?q=Paul+Detlefsen&oe=utf-8&aq=t&rls=org.mozilla:en-US:official&client=firefox-a&um=1&ie=UTF-8&hl=en&tbm=isch&source=og&sa=N&tab=wi&ei=gI2TUeXrKbD_4AO0i4G4DQ&biw=1280&bih=579&sei=n42TUZWrM8X-4AOv0YCADQ

That's a long URL...hope it doesn't alter the page width here.

My favorite Detlefsen piece is entitled, "The Letter"....I cannot find a good online image of the piece, but here is the jigsaw puzzle box image...the image was used by MB in their "good old days" jigsaw puzzle series, it is now quite rare.

http://thumbs1.ebaystatic.com/d/l225/m/m24-tZ7VEa-FE3S--beDSfA.jpg

There is a rural letter carrier, with letter in hand, in the center of the view, he and his horse & buggy along with the ferryman are all on a hand-operated ferrying raft, crossing a stream...a young lady, in the foreground, waits for the letter, as a nearby young boy, perhaps a younger brother and his dog do their things ....it's a very engaging image that every rural letter carrier would appreciate.

That painting has truly fallen through the cracks...I can't find a print of that piece....I'd certainly buy one, if I come across it....I have several Detlefsen prints.

Rasp acts as if he never saw an episode of Gilligan's Island...this erodes his cred even further.....from minimal to zero.

By: Captain Nemo on 5/15/13 at 8:32

Loner, I can remember seeing a storm years ago. After it had passed I went out and look at such a amazing sight in the distance. The lightning could be seen under a a thunderhead cloud, by a full moon. I will never forget how beautiful it was.

By: brrrrk on 5/15/13 at 8:32

Let's do what they do in Germany... drive impaired, lose your license. DONE!

By: Captain Nemo on 5/15/13 at 8:34

He doesn't to admit to his foolishness Loner.

By: Rasputin72 on 5/15/13 at 8:37

Nemo........Your graph shows that 47% pay no federal income tax.

As far as cops go I have a plan. Never ever put yourself in a position where one might be forced into dialogue with a cop.

I had seen the graph you pointed out. It certainly is interesting data. I am not sure what you wanted me to see , but along with other data it concisely pointed out that 47% paid no federal income tax. That is the only point I have made.

There is a category that troubles me. It is the working poor. This is the category that requires the most study. I have mixed feelings as to the cause and remedy for this.

I lean very strongly to a world market depressing wages in the USA for the unskilled. It should be a very high priority for every liberal .conservative, democrat or republican.

This is the category with whom I have the most empathy.

Surprised Tennessee isn't one of those red welfare states given that it has consistently received more in Federal funding than it has paid in Federal taxes for at least the past 30 years. Southern states constantly claim they are fiscally responsible, yet there isn't a damned one of them that could balance it's budget without Federal funding.

By: Captain Nemo on 5/15/13 at 8:44

The only point you have made Raspy old boy is that you think yourself about others. Now for as your plan goes, it must mean that you never leave your basement ghetto, which would explain your lack of common sense and understanding of world events.

By: Captain Nemo on 5/15/13 at 8:47

Me too bfra.

By: Rasputin72 on 5/15/13 at 8:50

LONER.......I am familar with Gilligans Island ( in passing) It certainly was not what I call a viewing staple. I remember vaguely a wealthy fat man (never knew his name) who must be your man Thurston Powell.

What little I recall is he had very little time for nit shit thinking.

By: Captain Nemo on 5/15/13 at 8:51

bfra, I suppose that there will always be a 47% or something like this as long as the GOP has it's way. LOL

By: Jughead on 5/15/13 at 8:52

Balls.

By: Jughead on 5/15/13 at 8:52

Why not lower it to zero? Isn't the goal to eliminate drinking and driving?

By: Captain Nemo on 5/15/13 at 8:53

Translation;

I could never afford a TV of my own.

By: Jughead on 5/15/13 at 8:56

I see that the liberal ladies are in full force here today.

By: Jughead on 5/15/13 at 9:02

Liberal men are the most pathetic excuses for human beings. They have spines of jelly, brains soaked with the semen of Michael Moore, and the resolve of a Frenchman.

No wonder Amerika is more concerned with gays rights than surviving the heinous and violent acts of muslims.

Then, these liberal femmes will blame GWB.

By: dargent7 on 5/15/13 at 9:11

Oh, for Christ's sake!
Then arrest everyone in France, Italy, Spain, and the entire North Coast of Calif. Sonoma to Napa down to Santa Barbara.
0.08% is barely a buzz. Then what's next? Marijuana THC meters?
Viagra, Zoloft, Paxil meters?
Focus on hollow point bullets, AK-47's, and unregistered semi-automatic hand guns.

By: dargent7 on 5/15/13 at 9:14

For the record: GW Bush was the WORST President in American history.
Just eg., look at his expression when Andy Card told him a 2nd plane hit the WTC. A blank stare went to frightened, to a frozen glare..

By: bfra on 5/15/13 at 9:22

d7 - Is it any wonder that the TROLLS stand up for Bush?

By: Rasputin72 on 5/15/13 at 9:33

bfra.........Is it any wonder that your carpet bagger leader LONER thinks Gilligan's Island is and was an intellectual beacon for every class?

By: bfra on 5/15/13 at 9:53

Raspy - Don't let Gilligan's Island get your goat! You have other bigger problems, mainly facing reality.

By: Captain Nemo on 5/15/13 at 9:55

Loner as never claimed the such, Raspy old boy. He says that like you Howell was a clown.

By: bfra on 5/15/13 at 9:58

Nemo - I didn't address that aspect, I assume everybody but trolls take anything Raspy puts on here, with a grain of salt.

By: dargent7 on 5/15/13 at 10:01

Some idiot mentioned he didn't know who Thurston Howell, III was played by...Jim Bacus , aka, Mr. McGoo.
And I'd take MaryAnn or Ginger over any of your skanky wives any day.
Can anyone even imagine what Juggy's, Raspy's, Yogi's wives even look like? YUCK!
....and Loner...Keep it up. w/o your intellect this bored would become balsa.
