A federal judge has thrown out the $25 million lawsuit that former Tennessee Titans receiver David Givens filed against the club last year.
The Associated Press reported that the lawsuit was dismissed by U.S. District Judge Todd Campbell because Givens’ claims were not separate from the collective bargaining agreement between the NFL and its players association.
If Givens is to pursue the matter further, he will have to go through the arbitration process that is used to settle grievances between teams and players.
Givens alleged that the Titans withheld information about the seriousness of his knee condition after he suffered an injury early in the 2006 season against Baltimore and never played again, even after several surgeries and the insertion of bone plugs into the knee.
Givens signed a five-year, $24 million deal with Tennessee as a free agent from the New England Patriots. That contract included $8 million in guaranteed money.
